Terms of Service

Effective: October 3, 2026 for new users; October 18, 2026 for existing users (15 days' notice, see Section 17).

These Terms of Service ("Terms") are a legally binding agreement between you ("you") and EatingMinds ("EatingMinds," "we," "us," or "our") for your use of the EatingMinds website at eatingminds.com, its web app and related services (the "Service").

By creating an account, signing in, or using the Service you confirm that you have read, understood and agree to these Terms, our Privacy Policy and our Safety Guidelines. If you do not agree, do not use the Service.

1. Eligibility

• You must be at least 18 years old and legally able to enter into a contract under Indian law.
• You must not have been suspended or removed from the Service, and must not be barred from using it under any applicable law.

We may ask for proof of age or identity at any time and suspend accounts that do not meet these requirements.

2. What EatingMinds is (and is not)

EatingMinds helps working professionals meet over a meal or coffee. The Service lets you:

• Create a professional profile (role, company, industry, skills, what you are open to) and optionally connect LinkedIn.
• Say which meals you are generally available for, and discover people by role, company or skill.
• Use Now to see who nearby is free right now, based on your device location while you use it.
• Send and accept meal requests, and chat with people once a meal is agreed.
• Block and report people.

EatingMinds is not a dating or matchmaking service, an escort service, a recruitment agency, a restaurant, a food-delivery or table-booking service, an events organiser, or an identity-verification service. We do not guarantee that you will find anyone to meet, that anyone will turn up, or that a meeting will be useful, pleasant or safe.

3. We are an intermediary platform

EatingMinds is an intermediary within the meaning of the Information Technology Act, 2000. Profiles, messages, requests and other content are created by users, not by us. We do not select the people you meet, choose or approve venues, or take part in arrangements made between users. Users are independent individuals: no user is our employee, agent, partner or representative, and nothing on the Service is an endorsement of any user.

4. Your account

• You may sign in with LinkedIn, Google or your mobile number (one-time password). Keep your information accurate and up to date.
• You are responsible for everything done through your account. Tell us at eatingminds.care@gmail.com if you suspect unauthorised use.
• One account per person. Your sign-in also works for our sister services (Daily AI at ai.eatingminds.com); see the Privacy Policy.
• Verification badges confirm only that a phone number was verified by OTP or that a LinkedIn account was connected. They do not confirm someone's identity, job, employer, intentions or character.

5. Conduct

5.1 You agree to

• Use the Service for genuine professional and social connection over meals.
• Be truthful about who you are: real name, your own photos, your real role and company.
• Treat everyone with respect, and accept a "no" or no reply without pressure.
• Meet only in public places and follow the Safety Guidelines.
• Turn up when you have confirmed a meal, or cancel in the app in good time.
• Comply with all applicable laws.

5.2 You must not

• Use the Service for dating, romantic or sexual solicitation.
• Harass, stalk, threaten, intimidate, abuse, defame or discriminate against anyone (including on grounds of religion, caste, gender, sexual orientation, disability or origin).
• Pressure anyone to go to a private place, to drink alcohol, or to share personal or financial information.
• Pitch, sell or solicit: no spam, multi-level marketing, investment or "get rich" schemes, loans, insurance or product sales, and no charging fees for jobs or introductions. Genuine conversations about work, hiring, mentoring or collaboration are welcome.
• Create fake or impersonating profiles, or use photos that are not of you.
• Collect or misuse other users' personal data, or contact them outside the Service against their wishes.
• Use bots, scrapers or automated means, or interfere with the Service's security or operation.
• Post illegal, obscene, sexually explicit, hateful or violent content, or content that infringes others' rights.
• Do anything unlawful, including under the Bharatiya Nyaya Sanhita, 2023, the Information Technology Act, 2000, and applicable state laws.

6. Offline meetings — your responsibility

Any meeting you arrange through the Service happens outside the Service, at a place and time you and the other person choose. You acknowledge and agree that:

• You decide whether to meet, whom to meet, where and when, and you are solely responsible for that decision and for your own safety and belongings.
• We cannot and do not control, monitor or guarantee the conduct of any user, online or offline, and we are not present at any meeting.
• Venues, food and drink (including allergies, hygiene and alcohol), travel to and from the meeting, and bills are matters between you, the venue and the other person. The "who pays" choice on a profile is a courtesy; we do not process, collect or guarantee any payment between users.
• Information other users give about themselves may be untrue. Use your own judgement and verify what matters to you.
• You meet other users at your own risk. To the fullest extent permitted by law, you release EatingMinds and its founders, employees and affiliates from any claim, loss or damage arising out of or connected with any meeting or interaction between you and another user, including personal injury, theft, loss of property, emotional distress, or financial loss.
• If you are a victim of, or witness, a crime, report it to the police (112) first, and then to us. We will cooperate with lawful requests from authorities.

7. Reports, blocking and moderation

You can block or report anyone from their profile or chat. Reports are reviewed by our team. We may (but are not obliged to) review content and accounts, use automated tools to screen photos and text, remove content, restrict features, or suspend or remove accounts, with or without notice, to protect users and the Service. Our review of reports or content does not make us responsible for user conduct.

8. Location features

Discover and Now use your home city and, when you allow it, your device location to show people near you and approximate distances. Other users see an approximate distance, never your exact location. Distances and availability can be inaccurate or out of date. Do not rely on them for safety, and never share your exact location (such as your home address) with someone you have not met.

9. Your content

You keep ownership of what you post (profile, photos, messages, reviews). You give us a non-exclusive, royalty-free licence to host, store, display, reproduce and adapt it as needed to operate, secure and improve the Service, including showing your profile to other users. We will not use your photos or messages in advertising without your consent. The licence ends when you delete the content or your account, except for copies other users already received (such as messages you sent) and backups kept for a limited period.

10. Fees

The Service is currently free. If we introduce paid features, we will show the price and terms before you buy. Meal costs are always between you and the people you meet (Section 6).

11. Our intellectual property

The Service, its design, software, logos and our own content belong to EatingMinds or its licensors. We give you a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, scrape, resell or create derivative works from it without our written permission.

12. Third-party services

The Service relies on third parties, including LinkedIn and Google (sign-in), SMS providers (one-time passwords), Google Firebase (notifications), OpenStreetMap (maps and places), and cloud and hosting providers. Their own terms and policies apply to your use of them, and we are not responsible for their services. Links to other websites (such as a user's LinkedIn profile) are provided for convenience only.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, to the fullest extent permitted by law. In particular, we make no promise that the Service will be uninterrupted, error-free or secure; that information provided by users is accurate; that any user is who they claim to be or is safe to meet; or that any meeting will happen or be satisfactory.

14. Limitation of liability

To the fullest extent permitted by applicable law:

• EatingMinds, its founders, directors, employees, affiliates and agents are not liable for the acts or omissions of any user or third party, online or offline, or for any loss, injury, damage or harm arising from meetings or interactions between users.
• We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or opportunity.
• Our total liability for all claims relating to the Service is limited to the greater of INR 1,000 or the amount you paid us in the 12 months before the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for our own fraud or wilful misconduct, or your rights as a consumer under the Consumer Protection Act, 2019.

15. Indemnity

You agree to indemnify and hold harmless EatingMinds and its founders, directors, employees, affiliates and agents from any claim, demand, loss, liability or expense (including reasonable legal fees) arising from your use of the Service, your content, your breach of these Terms or of any law, your violation of anyone's rights, or any meeting or interaction you have with another user.

16. Deactivation, deletion and termination

• Delete your account: Settings > Delete my account hides your profile immediately and cancels your listings, pending requests and upcoming meals. Your personal data is then permanently deleted within 30 days, as described in the Privacy Policy. Signing in again before then restores the account.
• By us: we may suspend or terminate your account, with or without notice, if you breach these Terms, if we reasonably believe you pose a risk to others, for unlawful activity, or to comply with law.
• Sections 3, 6, 9 and 13–19 survive termination.

17. Changes to these Terms

We may update these Terms. For material changes we will give at least 15 days' notice in the app or by email before they apply to existing users. Continuing to use the Service after that date means you accept the updated Terms; if you do not, stop using the Service and deactivate your account.

18. Governing law and disputes

These Terms are governed by the laws of India. Any dispute will first be attempted to be resolved through good-faith discussion for 30 days after written notice. If unresolved, it will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated in New Delhi, conducted in English. Subject to this, the courts at New Delhi have exclusive jurisdiction. Nothing here limits your right to approach a consumer forum where the law allows.

19. General

• Severability: if a provision is unenforceable, the rest remains in effect, and the provision applies to the maximum extent allowed.
• No waiver: not enforcing a right is not a waiver of it.
• Entire agreement: these Terms, the Privacy Policy and the Safety Guidelines are the whole agreement between you and us about the Service.
• Assignment: you may not transfer these Terms; we may, for example as part of a reorganisation or sale.
• Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
